1. Scope of services

Kargraft provides digital services that may include:

• website design and development;
• search engine optimisation (SEO);
• PPC and paid-advertising management;
• social-media management;
• digital strategy; and
• related digital and technical services.

Descriptions, examples, case studies and other material appearing on the website provide general information about Kargraft and its services.

They do not constitute a binding quotation, contractual commitment or guarantee that a particular service is suitable for a particular person or business.

Submitting a form, sending an email, contacting Kargraft through WhatsApp or speaking with Kargraft does not by itself create a client-service relationship.

A professional engagement becomes binding only in accordance with the quotation, proposal, service agreement or other written terms agreed between Kargraft and the client.

The applicable engagement documents may determine matters including:

• scope of work;
• deliverables;
• project stages;
• client responsibilities;
• timetable;
• revisions;
• third-party expenses;
• pricing; and
• payment conditions.

Where a specific client agreement conflicts with these general website Terms in relation to that engagement, the specific client agreement will prevail.

2. Quotes and payment

The Kargraft website does not currently permit visitors to purchase services or make payments online.

Any prices mentioned on the website are informational unless expressly identified as a binding quotation.

Project pricing, deposits, payment schedules, recurring fees, third-party expenses, cancellation terms and refund arrangements are determined in the relevant quotation, proposal or client agreement.

Submitting an enquiry does not entitle a visitor to receive a service at any particular price.

Nothing in these Terms limits any mandatory consumer rights that may apply under Israeli law.

3. Intellectual property

Unless otherwise stated, Kargraft or its licensors own the rights in the Kargraft website and its original content, including, where applicable:

• branding;
• text;
• graphics;
• layouts;
• designs;
• illustrations;
• interface elements;
• original photographs;
• original website components; and
• other original material.

Visitors may use the website for ordinary informational purposes.

Except where permitted by law, Kargraft-owned material may not be copied, reproduced, distributed, republished, commercially exploited or falsely attributed without permission.

Third-party trademarks, photographs, fonts, software, libraries and other third-party material remain subject to the rights and licences of their respective owners.

Ownership and usage rights relating to websites, source code, designs, written content, advertisements, graphics or other material created for a client are governed by the relevant quotation, proposal or service agreement.

Nothing on the public website alone transfers ownership of client deliverables.

Any right of Kargraft to display completed client work in its portfolio will likewise be governed by the applicable client agreement.

4. Liability

Kargraft makes reasonable efforts to maintain accurate and current information on the website. Nevertheless, website content is general in nature and may contain errors, omissions or information that later becomes outdated.

General information appearing on the website does not constitute a guarantee of any specific commercial result.

Results from SEO, paid advertising, website development, conversion optimisation, social-media activity and other digital services can depend on factors beyond Kargraft's control.

These may include:

• search-engine algorithms;
• advertising and social-media platforms;
• third-party services;
• market conditions;
• competitor activity;
• available budgets; and
• customer behaviour.

Unless expressly agreed otherwise in writing, Kargraft does not guarantee:

• a particular search-engine ranking;
• a particular amount of traffic;
• a particular number of leads;
• a particular conversion rate;
• specific advertising performance;
• uninterrupted availability of third-party platforms; or
• any specific level of sales or revenue.

The website may contain links to independent third-party websites or services. Kargraft does not control those third parties and is not responsible for their content, availability, terms, security or privacy practices.

To the maximum extent permitted by applicable law, Kargraft will not be responsible for indirect or consequential losses arising solely from reliance on general website information or temporary inability to access the website.

Nothing in these Terms excludes or limits liability or rights that cannot lawfully be excluded or limited.

Liability relating to a particular client engagement will be governed by the agreement applicable to that engagement.

5. Governing law and jurisdiction

These Terms and use of the Kargraft website are governed by the laws of the State of Israel.

Any dispute relating to use of the website will be subject to the jurisdiction of the competent courts in Israel, subject to any mandatory jurisdiction provisions under applicable law.

A specific client agreement may establish additional or more specific dispute-resolution provisions.
